Sachgrund: reading the stated reason in context

An English-language introduction to material reasons for fixed-term employment under German rules.

The word Sachgrund refers to an objective or material reason used to support a fixed term. It is not enough to translate the label; the stated reason must be understood against the actual role and circumstances.

Common settings

The TzBfG identifies categories that can include temporary operational need, replacement of another employee, the nature of the work, a probationary purpose, reasons connected to the employee, budgetary funds earmarked for temporary employment, or a court settlement.

These categories are not automatic approvals. Their application can involve detailed statutory and case-law questions.

Documents that add context

Alongside the contract, preserve the job posting, project or funding description, replacement references, organisational announcements and extension letters. Avoid collecting confidential material you are not entitled to retain.

Questions worth separating

What reason does the employer rely on? Is it written in the contract or explained elsewhere? Did the work continue beyond the circumstance described? Were there previous terms with the same employer? Each question may matter differently.
